Welcome to Anatomous ("Anatomous", "we", "our", or "us"). These Terms of Service (“Terms”) govern your access to and use of our website, web and mobile applications, AI-based tools, and any other services or content we provide (collectively, the “Service”).
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please discontinue use of the Service.
You must be at least 18 years old to use the Service. By using the Service, you confirm that you are of legal age and have the legal authority to agree to these Terms.
Anatomous provides a platform for users to manage their own health-related data and receive AI-generated insights. We are not a healthcare provider, and the Service does not offer medical advice, treatment, or diagnosis.

Not Medical Care
Anatomous does not provide medical advice, is not a medical provider, and does not practice medicine or offer patient care. The insights, responses, and tools provided are informational only and are not intended to constitute medical advice, instruction, diagnosis, treatment, or care.
Always consult your physician or other licensed healthcare provider before making health
decisions. If your provider has not authorized the use of this platform for your specific
condition, you should not use Anatomous as a substitute or supplement for professional
care.
Only for Communication Support and Informational Use
Users may only use Anatomous as a tool to aid in communicating with their healthcare
provider. You may not use Anatomous unless you have a primary care provider or
equivalent health professional with whom you will promptly review all information
produced by this Service. You agree to provide only accurate and truthful information
when using Anatomous. Always consult with your provider before taking action based on
anything generated by the platform.
Anatomous is not for emergencies.
Do not use the Service if you are experiencing a medical emergency or urgent health issue. In such situations, call 911 or seek immediate care from your nearest medical facility.
Not for Emergency Medical Situations or Mental Health Crises

If Anatomous detects conversation content related to these situations, it may automatically terminate the session and redirect users to appropriate resources. We reserve the right to immediately suspend or terminate any accounts found misusing the platform in this manner.

Important Disclaimer on Accuracy
Anatomous may generate inaccurate, incomplete, or outdated information. This includes, but is not limited to, responses related to conditions, medications, diagnoses, and treatment plans.
All information must be verified with your healthcare provider. Relying on Anatomous alone could result in harm, for which we bear no responsibility.

Your use of the Service is governed by our Privacy Policy. While Anatomous is not a Covered Entity under HIPAA, we voluntarily align with HIPAA best practices regarding the security and confidentiality of health-related information.
We do not sell or share your personal data without your consent. All sensitive data is stored using encryption and access controls, and we implement administrative and technical safeguards to protect your information.
Anatomous is not a “Covered Entity” under the Health Insurance Portability and Accountability Act of 1996 (HIPAA), nor are we necessarily a “Business Associate” as defined by HIPAA. Simply handling health-related information does not automatically subject an entity to HIPAA compliance.
While some users may choose to upload or input personal health information into the Anatomous platform, this does not create a doctor-patient relationship, nor does it make Anatomous subject to HIPAA solely by that action. The platform operates under direct-to-consumer health data regulations and complies with applicable federal and state consumer health data laws.
Important Note: Any information that you submit to Anatomous that is not specifically intended for the provision of clinical diagnosis or treatment is not considered “Protected Health Information” (PHI) under HIPAA. Such information will be handled in accordance with our Privacy Policy and applicable consumer data protection laws.
That said, Anatomous voluntarily aligns with HIPAA best practices, including data encryption, role-based access controls, and secure infrastructure to safeguard the confidentiality and integrity of your data.
By using the Service, you consent to receive communications from us in electronic form, including emails, platform notifications, and other digital formats. You agree that any notices, agreements, disclosures, or other communications we send electronically satisfy legal requirements that such communications be in writing.
We may communicate with you via email or SMS text message. These methods are not inherently secure or encrypted. You acknowledge and accept that Anatomous cannot ensure the security or confidentiality of messages sent through these channels.
If you do not wish to exchange personal or health-related information via email or text, you should discontinue use of the Service or contact us to adjust your communication preferences.

By providing any data through the Service, you grant Anatomous a non-exclusive, worldwide, royalty-free, irrevocable, perpetual, sublicensable, and transferable license to use, process, store, and analyze that data for the purpose of delivering and improving the Service.
This includes securely transmitting your data to third-party processors—such as artificial intelligence providers (e.g., OpenAI)—solely to generate insights or content you’ve requested. These third parties operate under contractual agreements requiring them to handle your data in accordance with our privacy and security standards.
You represent and warrant that you have the legal right to provide such data and that it does not infringe on the rights of any third party. You remain solely responsible for the content and legality of all data you submit through the Service.
Certain features may require account registration. You are responsible for maintaining the security of your account and password. You agree to notify us immediately of any unauthorized access or use.
If you subscribe to a Family Plan, the individual who registers as the Primary User is responsible for managing the subscription, including any linked profiles. By adding other users (including minors) to the Family Plan, the Primary User confirms they have obtained appropriate consent and accept responsibility for managing those profiles and associated data access.
We may suspend or delete accounts that violate these Terms or pose a risk to security, privacy, or platform operations.
All content, branding, functionality, and design elements of the Service are the property of Anatomous or its licensors and are protected by intellectual property laws. You may not reproduce, modify, distribute, or exploit any part of the Service without our written consent.
The Service may provide links to, or display references to, third-party websites, tools, products, or services (“Third-Party Content”). Anatomous makes no representations about the accuracy, legality, or suitability of such content and disclaims all liability arising from your use of or reliance on any third-party information or tools.

Anatomous may refer to or display information about certain goods or services ("Products"), including images, descriptions, links, or references. This information is provided for informational purposes only and does not imply endorsement, recommendation, or affiliation with any provider of the referenced Products or services.
Any content presented by professionals or third-party contributors is not a substitute for professional medical advice and does not establish a medical provider-patient relationship. All such content is for educational and informational purposes only.
We reserve the right to modify, suspend, or discontinue all or part of the Service at any time without notice. We may also revise these Terms from time to time. Continued use of the Service constitutes your acceptance of the latest Terms.
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We disclaim all warranties, including those of merchantability, fitness for a particular purpose, non-infringement, or data accuracy.

The Service is controlled and operated from the United States and is intended for U.S.-based users. We make no guarantees that the Service complies with international laws. International users access the Service at their own risk and are responsible for complying with local laws.
Telehealth Regulations Compliance
Anatomous may be subject to varying telehealth and digital health regulations depending on state, country, or region. You acknowledge that the availability, scope, or functionality of the Service may be restricted or limited by the laws of your jurisdiction.
It is your sole responsibility to ensure that your use of the Service complies with all local, state, and federal laws applicable to you. Anatomous makes no representations or warranties that the Service is appropriate, lawful, or available for use in all jurisdictions, including those outside the United States.
By using the Service, you agree that you will not:
Violation of any of the above rules may result in immediate suspension or termination of your account and access to the Service.
Any violation of these Terms may result in immediate account suspension or deletion without notice.

Anatomous reserves the sole right to determine what constitutes a violation. No refunds will be issued for services terminated due to Terms violations.
Users banned for Terms violations are permanently prohibited from using the Service. This includes:
Anatomous may terminate any associated accounts, block related IPs or devices, and take legal or technical steps to enforce permanent bans.
All disputes arising under or relating to these Terms shall be resolved through binding individual arbitration conducted in accordance with the rules of the American Arbitration Association (AAA). Arbitration shall take place in the State of Montana and shall be conducted in English.
Each party shall bear its own costs and attorneys’ fees unless otherwise required by law.
No Class Actions or Representative Proceedings
You and Anatomous agree to resolve any disputes individually. You waive the right to participate in any class action, class-wide arbitration, or other representative or consolidated proceeding.
This includes actions brought on behalf of other users, the general public, or any group. Any arbitration or legal proceeding must be conducted solely on an individual basis.
Monthly Subscriptions
You may cancel your monthly subscription at any time through your account settings. Cancellation will take effect at the end of your current billing cycle, and you will continue to have access to the Service until that date. We do not offer partial refunds for unused time within the billing period.
Annual Subscriptions
You may cancel your annual subscription at any time. Refunds for annual subscriptions will be provided on a prorated basis only if requested within the first 30 days after purchase. After 30 days, no refunds will be issued for unused portions of the annual subscription.
Example: If you cancel after 20 days, you'll be refunded for the remaining ~11 months. If you cancel after 40 days, no refund will be issued.
Promotional Offers and Free Trials
Subscriptions purchased during promotional offers or after a free trial period are non-refundable, unless otherwise stated. It is your responsibility to cancel before the end of any trial or promotional period to avoid being charged.
Requesting a Refund
To request a refund (when eligible), contact our support team at support@anatomous.com with your name, account email, and reason for the request. Refunds, when granted, will be issued to the original payment method within 7–10 business days.
Severability
If any provision of these Terms, including the arbitration clause, is found to be unlawful, void, or unenforceable for any reason, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
Non-Transferable
You may not assign or transfer any of your rights or obligations under these Terms without prior written consent from Anatomous. Any attempted transfer without consent is null and void.
Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Anatomous regarding your use of the Service and supersede any prior agreements or understandings, whether oral or written.
Force Majeure
Anatomous shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including acts of God, natural disasters, war, labor disputes, internet outages, government actions, or supply chain disruptions.
Billing Dispute Resolution Process
Before initiating any chargeback or payment dispute with your financial institution, you agree to first contact our support team at support@anatomous.ai with details of your billing concern. You must allow up to seven (7) business days for us to investigate and respond.
Failure to follow this process may result in the immediate termination of your account and services at our discretion. This policy helps avoid unnecessary disputes, interruptions, and costs for both parties.
Data Deletion and User Requests
You may request deletion of your account or personal data at any time by contacting us at support@anatomous.ai. We will process verified requests in accordance with applicable laws and our internal data retention policy.
